What we provide

  • We will create a clean, simple, professional website for your business.
  • We'll show you domain name options (example: yourbusiness.com), and you choose one.
  • We'll publish and host your website so it stays online (subject to billing being current and third-party service availability).
  • Email support for reasonable updates (example: hours, photos, phone number, address, services).
  • Mobile-friendly design that looks good on phones and computers.

What we do not provide

To keep our cost competitive, we focus on simple websites and we use basic templates to keep our pricing affordable. Here are common items that are not included unless we explicitly agree in writing:

  • Major custom design work (major layout changes, fully custom branding systems, animations, photo-website style congruence).
  • Complex website features (extensive multi-page websites, online ordering, e-commerce, membership portals, booking systems, blogs, custom web apps, server or network management).
  • Custom email domains / inbox setup (example: jane@yourbusiness.com).
  • Marketing management (ads, daily updates, posting about events, social media, social media management, public relations, lead qualification, search engine optimization).
  • Any industry-specific or non-industry-specific legal, tax, compliance, financial, or regulatory advice.
  • Photo/video production, photo/video editing, copywriting beyond light edits, or logo/brand design unless explicitly agreed upon in writing as a paid add-on.

If you need something outside our current scope, please email us! We can sometimes offer a paid add-on or recommend a partner. We're always trying to improve and may add new features in the future. Your feedback is appreciated.

Definitions

  • "You" and "Your" shall refer to Yourself as the customer and Your agents.
  • "We", "Us" and "our" refer collectively to ZemeZeme.
  • "Fees", "Pricing", "Cost" shall mean the prices for the Services as set forth in any written agreement between You and ZemeZeme.
  • "Services" shall mean any of the Services offered to you including website creation, transfers, modifications, management services, or other services requested by You and provided by ZemeZeme unless specified to be performed by a third party.

Support & communication

Support is handled by email. Please include your business name, location, and the change you'd like.

We aim to respond within 1–2 business days. Response times may vary during peak periods or holidays.

Billing

Payment Plan Overview

We currently offer two general payment structures. Exact pricing and details are listed on our pricing page.

Option A: Upfront + Monthly

• One-time upfront cost due before your website is published

• Followed by a monthly fee starting 30 days after initial payment

Upfront ──▶ Monthly ongoing

Option B: Higher Monthly + Lower Monthly

• Higher monthly fee during the first year

• First month fee due before your website is published

• Lower monthly fee after the first year

Higher monthly 1 year ──▶ Lower monthly ongoing

Payment plan availability, pricing, and terms may change and are confirmed at the time of signup.

  • Billing is monthly unless otherwise stated in writing.
  • You are responsible for paying on time.
  • You are responsible for keeping track of and managing your own recurring payment choices.
  • If a payment fails or your account becomes past due, we may pause or turn off your website until the balance is paid.
  • Your payment may include fees charged by our payment processor (example: processing fees). Those fees are outside our control.
  • Taxes (if applicable) may be added to your invoice depending on your location and the services provided.

We may send billing notices by email. If you do not receive them (spam filters, incorrect address, etc.), you are still responsible for timely payment.

Cancellation

You can cancel at any time. No long-term contracts. No penalties.

  • Just email us and say you want to cancel.
  • Once canceled, we will stop billing you for future months.

Refund policy (30-day rule)

If you cancel, you may request a refund for payments made in the last 30 days. Refund eligibility depends on your pricing option. See our pricing page for details.

Option A (Upfront + Monthly)

  • The upfront payment is refundable only if you request a refund within 30 days after your website is posted/published.
  • If eligible, the refund amount will include the upfront payment (minus any non-refundable third-party costs we already paid on your behalf, such as a domain registration fee, if applicable).
  • Payments older than 30 days are not refundable.

Option B (Higher Monthly + Lower Monthly)

  • If eligible, we will refund the first month's fee when the refund request is made within 30 days after your website is posted/published.
  • Payments older than 30 days are not refundable.

Refunds do not include third-party fees (example: payment processing fees) or non-refundable third-party services we paid for as part of your website request.

Ownership & transfer of files

  • You own your business content (logos, images you provide, text about your business, etc.).
  • If you cancel and have paid at least $500 in total fees after eligible refunds, you may request a transfer of your website source code and files, and we will provide them in a reasonable format (example: a zipped project folder or a repository export).
  • If you request a refund before you have paid at least $500 in total fees, you do not receive rights to the website source code and we will not transfer the source code/files.
  • We may reuse templates, components, and code across projects. You receive ownership of your specific website files subject to the payment threshold above.

Domain registration

  • Registration for a domain (example: yourbusiness.com) is performed through third party companies and requires specific contact information which may be disclosed, made available, or searchable to the general public per ICANN or registry policies as per our third party domain registrar. As a result, you may receive spam, marketing messages, or scam attempts from third parties. We do not control or endorse these communications and are not responsible for any scams, fraudulent activity, or damages that may result from third-party contact, emails, calls, or messages.
  • In addition to spam or scam attempts, you may also receive legitimate communications related to your domain, website, or business. These may include identity or contact verification requests, registrar confirmations, trademark or intellectual property disputes, law enforcement inquiries, or other regulatory or legal notices. You are solely responsible for reviewing, responding to, and complying with any such requests. We are not responsible for acknowledging, responding to, or acting on third-party or legal communications on your behalf. Our responsibility is limited to renewing your domain (where applicable under your service plan), and maintaining your website’s operation, provided that your account is in good standing, all required fees are paid on time, and you comply with these Terms and applicable laws. Failure to respond to legitimate requests in a timely manner may result in domain suspension, cancellation, or other consequences, for which we are not responsible.
  • When you move forward, you will be required to accept the terms and agreements of the domain registrar we use in order for us to register a domain on your behalf.
  • When you move forward, we will collect the required personal, business, and contact information separately. Your domain will be registered under your name, contact, and your business using the information you provide where possible. You are responsible for providing accurate, current contact information and for notifying us promptly (within 5 days) of any changes to avoid service disruptions or missed legitimate communications.
  • When possible and eligible, we will request the use of the third party company's WHOIS privacy setting to decrease exposure of your contact information.
  • For your convenience, we will set up and manage your domain under our account. You may, at any time, request in writing to manage your domain under your own account.
  • If you choose to manage your domain under your own account, we will work with you to transfer the domain to your account subject to the policies and limitations of the domain registrar. For ease of transfer, it is recommended that you create an account with the same domain registrar company that we use.
  • If you request a domain transfer to your own account, you are responsible for following up, completing, and confirming all approvals, actions, and confirmations required to successfully complete the transfer.
  • By using our service (unless you separately cancel our services), you agree to share any necessary information and permissions even after transfer for us to manage the domain and keep your website running.
  • Managing your own domain does not cancel your website service with us. You will continue to be billed the same monthly service fee for hosting, maintenance, and support unless you separately cancel the website service in writing.
  • If you manage your domain under your own account, you are solely responsible for all domain-related fees, renewals, settings, and maintenance. We are not responsible for domain issues, interruptions, or losses that occur as a result of actions taken (or not taken) in your own domain account.
  • Domain names are registered through third-party registrars and are subject to their rules and timelines. If a domain expires or is lost due to non-payment, failure to renew, late payment to us, breach of our Terms & Conditions, third party issues or policies during domain transfers, or issues outside our control, we are not responsible for any resulting losses, damages, or inabilities to recover the domain. Once a domain expires, it may be registered by another party and recovery is not guaranteed.
  • Domain availability is not guaranteed as the general public can also buy domains. If your first choice is unavailable, we will suggest alternatives. At this time we are only supporting .com domains.

Domain registration, domain management, and DNS services are provided through third parties, third party organizations, and/or third party companies. We are not affiliated or endorsed by these companies. Their policies and downtime are outside our control.

Data collection & records

We collect and retain the information needed to provide services and to meet our legal obligations (for example: billing records and tax documentation).

  • Information you provide (business name, address, phone number, content, domain registration details).
  • Billing information and invoices (handled through our payment processor).
  • Support communications (emails) for service quality and recordkeeping.

We do not sell your personal information. We may share information with vendors (hosting, domain registrar, payment processor) only as needed to provide our service.

Availability, warranties, and liability (important)

  • We provide the service “as-is” and do not guarantee uninterrupted uptime. Third parties (hosting, domain, payment providers) may experience outages. We are not responsible for issues caused by third-party services, including hosting providers, domain registrars, payment processors, or platforms outside our control.
  • To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.
  • We shall not be liable for loss, suspension, deletion, hijacking, unauthorized transfer, or compromise of any domain name or website due to registrar actions, registry policies, hosting company actions or policies, third-party failures, cyberattacks, security breaches, unauthorized access, or circumstances beyond our reasonable control, including those arising from customer account credentials or email compromise.
  • Neither party shall be deemed in default or liable for any failure or delay in performance under this Agreement (other than payment obligations) due to events beyond its reasonable control, including but not limited to: acts of God; natural disasters; fire; flood; storm; war; terrorism; civil unrest; labor disputes; government orders or regulations; failures or delays of hosting providers, registrars, DNS providers, or other third-party services; power or network outages; cyberattacks; or any other cause beyond the reasonable control of the affected party. The affected party shall provide prompt notice of such event and shall use commercially reasonable efforts to mitigate its effects.
  • Our total liability related to the service will not exceed the amount you paid us in the last 30 days (unless prohibited by law).
  • You may not use our service to create, host, or distribute content that is illegal, fraudulent, hateful, racist, discriminatory, sexually explicit, violent, or otherwise harmful or inflammatory.
  • You are solely responsible for all content displayed on your website and for verifying its accuracy, legality, claims, and compliance with applicable laws. We do not independently verify the legality or accuracy of your content.
  • If we believe your website content violates these terms or poses legal or reputational risk, we may remove or suspend the content or service, with or without notice.

Some jurisdictions do not allow certain limitations. In those cases, the above limitations apply to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless us, our company, and our contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Content you provide or approve for your website, including claims, images, logos, text, or offers.
  • Your business’s products, services, advertising, or representations.
  • Any violation of laws, regulations, or third-party rights (including intellectual property rights).
  • Your breach of these terms.

Your responsibilities summarized

  • Provide accurate, up-to-date information about your business.
  • Confirm you have the rights to any content you provide (e.g. logos, photos, text).
  • Review and approve your website before we publish it.
  • Keep your monthly payments current to avoid service interruption.
  • Notify us if your business details change (hours, phone number, address, etc.).
  • Ensure all content on your website complies with applicable laws and regulations.
  • Do not submit or request content that is illegal, fraudulent, hateful, racist, discriminatory, defamatory, or intended to incite harm or harassment.
  • You are fully responsible for the accuracy, legality, and compliance of all content on your website, including claims, pricing, licensing, and disclosures.

Changes to these terms

We may update these Terms from time to time. If changes are material, we will post the updated Terms on this page and update the “Last updated” date below. Continuing to use the service after changes means you accept the updated Terms.
